EU Chinese-EV Imports in 2026: A Price Undertaking Is Not a General Duty Waiver

Reports of EU–China price undertakings can sound like a general removal of duties on Chinese EVs. For an importer, that is the wrong starting assumption. An undertaking is a specific accepted arrangement with conditions, and its benefits do not automatically extend to every manufacturer, model, intermediary or transaction.

The procurement file should identify the actual producer and applicable measure before a landed price is promised to a customer. A familiar brand name and a low export quotation are not sufficient to establish the customs treatment.

What changed in 2026

On 12 January 2026, the Commission issued guidance on undertaking offers. The announcement concerns proposals in the context of the BEV countervailing measures; issuing guidance is not the same as accepting every exporter’s offer.

On 10 February, the Commission accepted an undertaking involving Volkswagen Anhui’s CUPRA Tavascan. The announcement describes a model-specific minimum-price arrangement and additional commitments. It illustrates the need to check the accepted legal scope, rather than interpreting one decision as a waiver for all China-origin BEVs.

These examples are not an exhaustive register of every measure at a later entry date. The importer should check the current legal act and tariff data for the actual transaction.

Start with producer identity and product scope

Question Evidence needed Why a headline is insufficient
Who produced the car? Manufacturer entity and accepted identification Brand and exporter can differ from producer
Is the product in the measure’s scope? Classification, powertrain and technical description “NEV” includes more than BEVs
Which duty treatment applies? Current tariff and relevant producer code or evidence Rates are not chosen from the brand’s advertisement
Is there an accepted undertaking? Governing decision and its applicable parties/product A submitted proposal is not an approval
Does this sale meet the conditions? Required transaction, price and document evidence Model eligibility alone may not satisfy the arrangement

Have the customs representative map the producer and vehicle to the current treatment. Do not use a rate associated with another entity merely because the cars share a brand or distribution network.

Minimum price changes the quotation question

Where an undertaking applies, the compliant transaction must satisfy its actual price and other terms. A seller’s claim that it can provide the same exemption below the accepted conditions deserves careful review, not automatic inclusion in a dealer margin forecast.

The Commission’s guidance addresses matters such as sales channels and cross-compensation. The importer should examine the complete commercial arrangement rather than judging only one invoice line. Artificially moving vehicle value into another charge is not a reliable basis for a duty-exemption claim.

Ask the exporter to identify the legal basis and required documents in writing. If it cannot, prepare the cost scenario using the applicable ordinary duty treatment instead of assuming relief will be arranged later.

Keep the tax layers visible

A countervailing-duty exemption is not necessarily an exemption from ordinary customs duty, import VAT or other costs. Each amount has its own basis and conditions. Request a dated calculation with customs value, duty lines, VAT treatment and destination preparation.

An illustrative ten-percentage-point change on an assumed EUR 25,000 relevant base is EUR 2,500. This is arithmetic showing sensitivity, not a quoted EU duty rate or a prediction of the car’s VAT-inclusive landed cost. Tax bases and interactions must be calculated under the actual rules.

For a VAT-registered importer, distinguish recoverable tax from the cash needed at entry. A credit expected later should not conceal an immediate funding requirement.

Approval and ownership support remain separate

The trade measure does not establish EU whole-vehicle approval, registration eligibility or a valid CoC for the China-market VIN. Verify the road-approval file independently. A vehicle eligible under a tariff arrangement can still have an unresolved technical admission problem.

Confirm destination charging, software and warranty scope. If the offer relies on a parallel-import support arrangement, identify who supplies diagnosis, labour and parts. Do not infer official local manufacturer support from the existence of an EU sales network.

Request a producer-specific EU quotation

Send the EU destination, importing entity, model and exact producer information through our contact page. Request the original vehicle and transaction file with the export cost checklist, then have your customs representative confirm the current measure and any undertaking conditions before committing to shipment.
